Terms of Use

1. Acceptance of Terms

These Terms of Use (the "Terms") constitute a binding and enforceable legal contract between Hustlz Nigeria Limited (the "Administrator", "we", "us") and you.

• Your access and use of the Hustlz website and mobile applications, as well as any service, content, and data available via them (together, the "Service" or the "Platform") are governed by these Terms.
• If you do not agree with any part of these Terms, or if you are not eligible or authorized to be bound by the Terms, then do not access or use the Service.
• Please also review our Privacy Policy. We reserve the right to make changes to these Terms at any time with or without prior notice.

2. Important Disclaimers

• All services rendered by the Administrator are provided "AS IS", "AS AVAILABLE" and "WITH ALL FAULTS". We disclaim all warranties, expressed or implied.
• Administrator has no control over and does not guarantee the quality, safety or legality of services published by users; the trustworthiness of information provided by users; the ability of hustlers to complete work; or that users will complete transactions.
• You are encouraged to verify credentials, meet in safe public places, and conduct due diligence before engaging with any user.
• You acknowledge that you are solely responsible for your safety when meeting other users.

3. Account Registration

• To use certain features of the Service, you need to register an Account and provide accurate information.
• You may register only one Account per person.
• You are responsible for maintaining the confidentiality of your Account access and for all activities under your Account.
• You must be at least 18 years old or have permission from a parent/guardian to use the Service.
• We reserve the right to suspend or terminate your Account if you breach these Terms, we detect suspicious activity, or you engage in fraudulent activities.
• You agree to notify us immediately of any unauthorized use of your Account.

4. The Service

• The Platform is an online service that allows users (Hustlers) to offer services and skills, and other users (Clients) to find and hire them.
• The Administrator is not an employer, contractor, or provider of any service posted by users. Contracts are entered into directly between users.
• Users are solely responsible for collecting and remitting any applicable taxes.
• We reserve the right to delete or block gigs and profiles that breach these Terms or applicable law.
• We may implement changes to the Service at any time with or without notice.
• The Service may contain links to third-party websites. We are not responsible for third-party content.

5. Posting Gigs & Profiles

• Users shall provide accurate and complete information about services offered or needed.
• Phone numbers and contact details must be reachable and accurate.
• Pricing must be exact and transparent. Any variable pricing must be clearly stated.
• Gigs and profiles must not include false, misleading, or deceptive statements.
• Users must not post illegal content, spam, or content that violates others' rights.

6. Fees & Payments

• The Platform is currently free to use. We do not charge any fees for posting gigs or applying to gigs.
• Hustlz does not collect or process payments. All payments are arranged and made directly between hustlers and clients.
• We are not responsible for payment disputes between users. We recommend agreeing on payment terms before starting any work.
• If we introduce paid features in the future, any fees will be clearly disclosed before you incur them.

7. User Representations and Warranties

By using the Service, you represent and warrant that:

• You have the legal capacity and agree to comply with these Terms
• You are above 18 years of age
• You will provide true, accurate, and complete information
• You will not use the Service for any illegal or unauthorized purpose
• You will not post content that infringes others' rights
• You will not harass, threaten, or discriminate against other users
• You will not attempt to interfere with the normal operation of the Platform
• You will not harvest user data without consent
• You have the necessary authorization to offer services described in your profile

8. Indemnity

You agree to indemnify and hold the Administrator, its affiliates, officers, directors, employees, and agents harmless from any claim or demand, including legal fees, made by any third party due to or arising out of: your use of the Platform; your content; your violation of these Terms; your violation of any applicable law; or any transaction entered into by you via the Platform.

10. Intellectual Property Rights

• Content you submit remains your intellectual property. However, you grant us a non-exclusive, worldwide license to use, display, and distribute your content in connection with the Service.
• You agree not to infringe the rights of any third party.
• Materials on the Platform (excluding user content), including trademarks, logos, and graphics, belong to or are licensed by the Administrator.

11. Governing Law and Jurisdiction

• These Terms shall be governed in accordance with the laws of the Federal Republic of Nigeria.
• Any dispute arising out of or in connection with these Terms shall be resolved by arbitration under the Arbitration and Conciliation Act of Nigeria. The seat of arbitration shall be Lagos, Nigeria.

12. Miscellaneous Provisions

• If any provision of these Terms is held to be invalid, the remaining provisions shall remain in effect.
• We may transfer our rights and obligations under these Terms to any other person.
• Our failure to take action on a breach does not waive our right to act on subsequent breaches.
• We shall not be liable for any failure to comply due to factors outside our reasonable control.
